Hedge Fund Giant Paul Singer Tries to Buy California for Rudy

In last week's Action Point Reference Shelf link Mukasey: Chrony for the next Republican President? The religious right hates him but Giuliani loves him, I asked: Is the RNC positioning already? Or is there an inside voting-related job needed to get Rudy elected?

This week we find Vulture fund manager Paul Singer ain't taking any chances on DOJ election manipulation working out: CALIFORNIA MONEYMAN UNMASKED:
Rudy Giuliani’s top fundraiser, hedge fund giant Paul Singer, revealed himself today as the sole financial backer of a stalled ballot drive to turn California into a motherlode of Republican votes in 2008.

The ballot initiative, if approved, would have changed how California apportions its electoral college votes. Under the states’ current winner-take-all system, the Democratic nominee has traditionally pocketed all 55 electoral votes in the left-leaning state — the nation’s largest electoral prize.

Instead, electoral votes would be apportioned to the winner in each congressional district — a change likely to shift up to 22 of those 55 votes into the GOP column, given the number of safely Republican districts in the state.

For the GOP, it would be a bonanza, akin to adding a large, new Republican state to the map.

The Gay Old Party contributed 30 years of sweat and treasure to strategize the SCOTU installation of the single-purpose, one-use corporation known as Bush/Cheney, to destroy democracy as we know it and they will do whatever it takes to finish the job. What is that job? Why of course, drowning representative government (competitors for power--you and me) in a BATHTUB!!!

Kent State: Are We There Yet?

So what if a smart-ass college kid gets tazed?

I love Greg Palast, but taking a book, even one as dangerous as Armed Madhouse, to a protest in the year 2007 is like taking a knife to a gun fight. But it could get worse. Remember murdered students at Kent and Jackson State in the 1970's?

Maybe it was not only the endless arrival of flag-draped coffins, or the daily news' "Official Body Count" intoned by burned-out journalists. Maybe in the end it was American Guards killing American kids on American soil that finally sickened America into shaking off-- if only for a moment-- faith in a war gone so wrong we killed our own children attempting to silence their rightful objections. After all, it was they who were dying, not their parents.

Are we there yet?

These are the anniversaries of the 1970 murders of student antiwar protestors at Kent State University in Ohio and Jackson State College in Mississippi by military and lawmen. These murders marked a turning point in the war and the protest against it. The antiwar movement grew up with those murders. Now, protest meant risking one's life. The U.S. government had made it clear once and for all that it would tolerate only so much dissent."

911.

Another 911 come and tomorrow, gone.

The thing most changed is the visibility of 911 Truth, the movement that has sprung up around the tragedy to challenge what adherents call the "Official Story". Their goal to expose the "false flag" they claim was 911 and thereby force Americans Everywhere to pressure the Bush administration to its knees has so far failed. So have plans to extricate US forces from Iraq.

Oh well, the conventions probably make for a nice party where all the "buddies" can clump up together and speculate, fantasize and otherwise create discover more unanswered questions.

Interesting thing about 911 Truth is the choice of words for its "title". If I didn't know better (and I don't) I'd say that a GOP operative like Frank Luntz engineered the movement name. Healthy Forests, Clear Skies, 911 Truth?

Oh well, I better be careful. Before someone suggests I'm a mole...

KLKA proposes move from Globe to Casa Grande


Secret payout kept from public

Move will result in 600% power increase, change in frequency, and no local broadcasting. If approved, will shut out all locally controlled community radio in Central Arizona and the East Valley.


American Educational Broadcasting (AEB) is a Florida corporation with its headquarters in Las Vegas. It owns many stations across the country, and its directors have controlling interests in many other stations. Among the stations which AEB owns is KVLT in Temple, Texas.

In 1996, AEB requested a construction permit for a 1.4 kilowatt station in Globe. This was a relatively small station, and covered Globe, Superior, and Miami. The application requested a frequency of 88.5 FM under the claim that the station was a “educational” station” like KJZZ, KXCI, or KBAQ.

The application was approved in 2005, and then it just sat there. No station was ever built, no license was ever granted, but the construction permit successfully kept other community based educational radio stations from developing in Globe.

For many years, federal law required that the Federal Communications Commission (FCC), which authorizes construction permits and grants licenses, could not approve a station application unless the station had a studio in its city of license and most of its programming had to be local. This requirement was to make sure that national networks and conglomerates did not completely devour local stations. But the federal law changed, to allow stations to act as satellites for out-of-state stations, to become what radio broadcasters called “translators on steroids.”

The FCC also began a process of granting what it called “minor modifications,” that is, small changes in a station’s construction permit or license which would allow it to operate more effectively. The problem with the minor modification rule is that very little public notice is required, most people in the affected area have no idea that the modification has been requested, and there is no formal procedure for opposing a minor modification request. The minor modification rule allowed multi-state media conglomerates to skulk around under cover and change small stations like KLKA into “Big Foot” media giants.

That’s exactly what happened here. In 2006, American Educational Broadcasting requested a “minor change” for KLKA to allow it to just re-broadcast programs from KVLT in Texas. So much for local control. “By the way,” AEB said, “the public file that every station is required to maintain so that local people can check up on their local station, we’ll put that local public file in Temple, Texas, but don’t worry, folks, we’ll give you a toll free number to call if you want information.” No one was paying much attention, so no one opposed it, and the minor modification was granted.

About a year ago, the FCC announced that for the first time in eight years, it was going to open up an opportunity for local organizations to apply for educational radio construction permits and licenses. Central and southern Arizona community groups saw this as the last opportunity to bring real community based radio to their regions.

There was an open frequency in Pinal County which would have allowed a locally controlled educational station to apply for a station Local organizations were preparing their applications when Big Foot stepped in and crushed their plans.

Big Foot

Many organizations had requested that the FCC put a freeze on further minor modifications until the new filing window (which was only five days long) closed so that the mega-media conglomerates wouldn’t try to squeeze out local groups that wanted real community radio. “That sounds pretty reasonable,” said the FCC on August 8, “we’ll freeze all minor change applications after September 9.” Of course, the multi-state conglomerates knew what the FCC was saying, “Get your minor modifications in while you can.”

And that’s exactly what they did. The ink was barely dry on the FCC’s freeze announcement when American Educational Broadcasting filed for a “minor modification” which moved KLKA from Globe to Casa Grande, right in the middle of the open frequency, and which increased its power from a puny 1.4 kilowatts to a whopping 83 kilowatts. For comparison, KBAQ is only 12.5 kilowatts. Not only that, but AEB also wanted the FCC to continue to allow them to just rebroadcast from Texas, and by the way, keep those public files down in Texas too.

But AEB had problems, like the fact that other stations already occupied some of the space that KLKA wanted. So AEB worked out a deal. One station, KZAI, owned by Educational Media Foundation, was in Coolidge, and broadcast at 10 Kw. It agreed to reduce its power to 8 Kw. KAIC, also owned by Educational Media Foundation, agreed to move off its 88.9 frequency, and move its 1.5 Kw station from Coolidge to Mammoth. And who did all this complex engineering? An engineer from Educational Media Foundation. Finally, if everyone agreed to this, then another station, KFLT, owned by Family Life Broadcasting, would agree to move to a new tower and reduce its power.

Of course, all of this switching and moving and reducing power wasn’t done merely from a sense of charity and grace – money changed hands as well. How much money? The 250,000 folks or so in KLVA’s new territory will never know, because AEB asked the FCC to seal the agreement and keep it secret. That agreement probably won’t be showing up in the public records book in Temple, Texas.

Still Time to Do Something

As of now, the FCC has not approved the “minor modifications” which will result in major changes for Big Foot and the destruction of any chance for real community radio in Central Arizona.

But there’s still time to save community radio in central Arizona. The FCC will listen to public opinion on these issues, and if you want to stop Big Foot, just copy the letter below and mail it to the FCC today. You can call the FCC toll free at 1-888-225-5322. I support real community radio. I want you to deny the application of KLKA to move from Globe to Casa Grande and to reject their power increase request. This is not a minor modification; it is creating a new station. If AEB wants a new station, they should apply in October like everyone else.

Will The Gay Larry Craig Please Stand Up?

This past week-end I spent at least an hour over a rather fabulous dinner at 1480 KPHX sponsor Harley's Italian eaterie, with a very good friend (also rather fabulous I might add) discussing Senator Larry Craig.

My friend it seems, with the idealistic principles of Dennis Kucinich minus the desire to act on them, held the position that Democrats were missing a perfect opportunity. He thought Larry Craig the gay man, should find champions in some faction of the Democratic party, at least the GLBT sector, to come out (no pun intended) and advocate for his rights! Craig was, after all, being persecuted by Republicans for being gay, not for a misdemeanor crime. Senator David Vinter on the other hand is *not* facing Republican ousting (presuming he did have sex "with that woman") because he is straight.

While I spent most of the time arguing that having sex with the same sex did not make you gay (ambi-homosexuals and ambi-heterosexuals may be less known but make up some portion of "homosexual" activity) and secondarily that it was not in Democrats best interest to back a guy that was first, a hypocrite and second, accused of a crime, my friend kept hammering on the "principle" thing; it was a mater of principle: being gay should not net the punishment of expulsion from public service (again, no pun intended) and Democrats should be the party willing to say it!

Given all that, now that Larry has decided to fight back should he just "come out" as a gay man and fight the misdemeanor charge (maybe it was entrapment) still registered as a Republican? I think so, because that of course allows people like me to mercilessly roast the entire Republican party for throwing poor Larry "at" (not even under) the bus while the Gay Old Party goes into denial over Vinter, but what does it do for Craig?

Well, if --when the investigation gets really ugly decoding the Madam's diary linking Vinter with oh-- gay WH press/hooker Jeff Gannon --Larry's little rub (okay, that was a pun) starts to look like positively great news! Then Craig can reregister as an Independent, caucusing with Democrats to screw Republicans on important "family values" legislation (not to mention war funding) and throw the whole damn party under the bus!!

Well, it wasn't me who was arguing about principles!

Ozarks Going Green

People come to compacting from a diverse background and for a lot of reasons. Some are doing it for thrift or simplicity. For others, it is an act of protest against an out-of-control corporate machine. Another cornerstone to compacting is sustainability. Simply refusing to contribute to an unsustainable system is likely the primary motivation for most compacters.

When we moved from California to Springfield, Missouri, we hardly expected to find anything on the cutting edge of sustainability. In our blue-state arrogance, we thought the San Francisco Bay Area had a lock on such things. Matt O'Reilly, the owner of Dynamic Earth outdoor outfitters and developer of the Green Circle shopping center is proving us wrong.

Green Circle is shooting for a Leadership in Energy and Environmental Design (LEED) Platinum rating. This platinum rating isn't easy to come by, and if he succeeds, O'Reilly's shopping center will be the first anywhere to get that rating.

The shopping center shares parking space with an area church, so no new land is paved for those parking slots. The roof collects and recycles rainwater, Skylights cut down on the need for interior lights, and at every turn, the consumption of resources is managed for the center and its tenants.

It will soon be the centerpiece of a surprising number of area green building innovators and innovations. Local startup company theworkshop 308 LLC is focused on green furniture and green building techniques. The Discovery Center, our local children's science museum, just got its LEED gold certification and local firm EWI plans to build a LEED certified headquarters. It has been a real surprise to us to find how widespread green building techniques have become here in the Ozarks.

Michelle Mulder, counsel to Rep. Rush Holt, has just informed supporters of HR 811 that the bill will come up for a vote on the House floor next week.
